Recently awarded Amazon Business contract complies with federal and Texas laws |
|
Choice Partners' newly awarded contract to Amazon Business allows governmental entities across the United States the opportunity to purchase goods via a competitively procured contract that complies with applicable provisions of the federal Uniform Guidance, 2 CFR Part 200 (a.k.a. EDGAR for k-12 institutions), and for those entities in Texas, also includes the numerous certifications required by Texas statutes. |
| Choice Partners’ competitive procurement solicitation included detailed evaluation and contract award criteria, with price being the most heavily weighted factor – a requirement imposed by the Texas Department of Agriculture when spending child nutrition funds. The procurement also complied with applicable provisions imposed by 2 CFR part 200, such as ensuring no geographic preferences were imposed, taking the mandatory 6 affirmative steps, and imposing record retention requirements.
Amazon Business executed all applicable certifications outlined in Appendix II of 2 CFR Part 200 Contract Provisions – including termination for cause and convenience, equal employment opportunity, debarment and suspension, anti-lobbying, and more. Amazon Business also signed all applicable Texas-required certifications – including certifications regarding terrorist organizations, boycotting of Israel, boycotting certain energy companies, prohibiting discrimination against firearm and ammunition industries, and contracting information. The signed federal and Texas certifications and the contract are available to Choice Partners members in the due diligence file on the CP website, saving CP members significant time and effort in ensuring legal requirements are fulfilled. |
