Paraquat Multidistrict Litigation Update:
Cases Continue to Grow and Selection of Bellwether Trial Moves Forward
A growing number of paraquat lawsuits are continuing to be filed in the national Paraquat Multidistrict Litigation by farmers and agricultural workers across the country who have been diagnosed with Parkinson’s disease. At the time of the case consolidation under the multidistrict litigation, about 80 paraquat cases were pending in various federal courts. Now the lawsuits are mounting with nearly 400 cases filed, as stated in a recent coordination order. As the paraquat attorneys review and file cases, it is ultimately expected that the litigation will continue to grow into the thousands of claims.

Research Finds Defective Cochlear Implants
Cochlear ear implants can be very effective, even miraculous, in helping deaf and hard-of-hearing individuals gain the ability to experience sound. Unfortunately, at the same time, cochlear ear implants have a history of serious problems and defects.

In August, manufacturer Advanced Bionics announced that 16% of implants worldwide are defective. The numbers found by the renowned Hannover Hearing Center are even higher - of the 349 patients studied 50% were determined to be defective. These findings are alarming when compared to the expected failure rate for cochlear implants which is less than one percent.
TEAM UPDATES
Amber is the newest addition to our growing intake department, working as a file clerk. Over the last few weeks at Meyers & Flowers, our client services’ team has taught her the ropes for requesting medical and billing records. She will be responsible for contacting medical facilities and their record release departments as well as checking the status of our requests to better serve our clients. Amber’s upbeat personality and excitement to learn are a great asset to the firm. 
Joseph will be working in our mass tort department. Currently, he is assisting trial attorney Peter J. Flowers with document review, client calls, and research involving our case for hundreds of clients who have developed Parkinson’s disease due to long-term exposure to paraquat.

After receiving his bachelor’s degree in philosophy from the University of Nevada, Las Vegas, Joseph is now pursuing his Juris Doctor degree at Northern Illinois University College of Law – Go Huskies! 

Partner Craig D. Brown is one of several nationally recognized trial lawyers who was selected to speak at the New Jersey Meadowlands Seminar. Craig presented on the dangers of pressure cookers, taking from what he and the Meyers & Flowers team have learned while representing dozens of people who have suffered severe burn injuries while using defective pressure cookers.

Kristin Roos is a dedicated paralegal that joined our team in 2019. Kristin graduated from Purdue University with a B.S. in Public Health Promotion and Loyola University with a Certificate of Paralegal Studies.

Prior to joining our firm’s personal injury team, Kristin spent four years gaining invaluable experience as a litigation paralegal. Kristin currently applies her extensive knowledge and unique skillset by managing a variety of cases while simultaneously providing valuable support to our attorneys.

TIPS TO CELEBRATE SAFELY THIS HOLIDAY SEASON

Throughout the month of December, as more cars hit the road to join family and friends to celebrate the holiday season, drunk driving crashes increase. Two of the most celebrated days in December – Christmas Eve and New Year’s Eve – are also among the most dangerous. Unfortunately, every holiday season, lives are lost due to impaired drivers. National Impaired Driving Prevention Month serves as a reminder that we must take action to keep our nation’s roads safe. 
PRE-PARTY: 
  • If you will be traveling for a celebration, plan how you are going to get home safely prior to attending. 
  • Choose a party guest or friend/family member as a designated driver who will commit to remaining 100% sober for the night. 
  • Take a taxi, train, bus or carpool. 
  • To avoid surcharges or a lack of drivers, schedule your rideshare, like Uber or Lyft, beforehand to ensure that you will have a driver exactly when you need it. Instructions on how to do so within the Uber app can be found here
  • Don’t mix alcohol with over the counter and prescription drugs. If you are taking any prescriptions, make sure to read the side effects and determine whether it is safe to consume alcohol while taking them. 

HOSTESS WITH THE MOSTESS: 
  • Collect each guest’s car keys upon arriving and store them in a designated basket to keep track how they will be getting home. 
  • Serve food as well as alcohol-free beverages. There are many creative mocktail recipes you can serve as well as soda, juice, and water. 
  • If making an alcoholic punch, have the base be fruit juice instead of a carbonated drink. Alcohol absorbs faster into the blood stream when mixed with carbonation. 
  • Offer to have guests stay the night at your home if they do not have a safe ride alternative. 

ON THE ROADS: 
  • The key to drinking and driving is: don’t. Every body is unique and not all alcohol is created equal so avoid following rules like the “one drink, one hour” rule. 
  • If you see a driver that seems impaired or is recklessly driving on the road, contact your local law enforcement immediately to report the occurrence. 
  • Always wear your seat belt – it is your best defense against impaired drivers 
  • If possible, try to avoid driving during peek drunk-driving hours. Research indicates from midnight to 3 a.m., two-thirds of fatal crashes involved an alcohol-impaired driver – twice the overage average.
