This was a lighter week in Augusta with most committee activities on pause Wednesday, Thursday and Friday to give legislators the opportunity to participate in the always anticipated MDF bus tour.


This year, the tour included stops at two MFPC member locations on Thursday with one bus heading to the Tiny Homes of Maine facility in Dyer Brook that was recently acquired by Hancock Lumber while the second bus continued up the road to tour LP Building Solutions in New Limerick. Both tours were well attended and informative.


We would like to thank MDF for shining a light on some of the exciting products being produced from Maine's forests, and for allowing us to tag along for these informative tours.

While we appreciated the change of venue towards the end of the week, there is still some action to report on legislation of interest.


On Tuesday, the Council testified before the ACF Committee in support of LD 39, "An Act To Require Forest Landowners To Report The Registration Or Sale Of Their Forest Carbon Credits". As you will see below, the work session on this bill will take place next Tuesday.


We also have kept a close eye on the Appropriations and Financial Affairs Committee as they deliberate on the supplemental budget, LD 209. While continuous progress has been made at various meetings this week, the Committee has not yet made a determination on Part U which includes critical funding to implement an Early Intervention Strategy (EIS). With a quickly growing spruce budworm population now impacting roughly 250,000 acres across dozens of land ownerships in northern Maine, this funding is a top priority for the Council and for our industry.

This upcoming week, the Council will engage on a number of policy issues ranging from illegal dumping to weight limits for oversize ATVs and more. If you have any questions about the bills below, or our policy positions, please don't hesitate to reach out.

LD 121 - "An Act To Include Brush And Yard Debris In The Definition Of "litter""

Sponsored by Senator Black on behalf of the Council, LD 121 would amend the Maine Litter Control Act by adding brush and yard debris to the definition of "litter." Please consider submitting testimony in support of this bill.

LD 60 - "An Act To Allow Employees To Request Flexible Work Schedules"


Public Hearing in LAH on Wednesday February 5, 2025 @ 10:00 AM in Cross Building, Room 202


MFPC Position: Oppose


Sponsored by Representative Roeder, LD 60 would allow an employee to request in writing a flexible work schedule. The bill requires the employer to consider the request, and it prohibits retaliation. MFPC is opposed because of concern that the retaliation provision could be abused by employees who are terminated for unrelated purposes, and because this law would interfere with the collective bargaining process.

LD 19 - "An Act To Change The Definition Of "oversized Atv" In The Laws Governing The Registration Of All-terrain Vehicles"


Public Hearing in IFW on Wednesday February 5, 2025 @ 1:00 PM in Cross Building, Room 206


MFPC Position: Oppose


Sponsored by Senator Moore, LD 19 would increase the minimum weight of an oversized all-terrain vehicle from 2,000 to 2,500 lbs. MFPC is opposed because this bill runs counter to recommendations from the ATV Task Force.

LD 195 - "An Act To Create The Small Business Capital Savings Account Program"


Public Hearing in HOUSING AND ECONOMIC DEVELOPMENT on Thursday February 6, 2025 @ 11:15 AM in Cross Building, Room 206


MFPC Position: Support


Sponsored by Senator Stewart, LD 195 would establish the Small Business Capital Savings Account Program in the Department of Economic and Community Development to certify small businesses engaged in commercial agricultural production, commercial fishing or commercial wood harvesting eligible to claim a tax deduction for contributions made to qualifying small business capital savings accounts to be used for capital expenditures. The bill creates the tax deduction and establishes that withdrawals from the savings accounts are taxable income if not used for capital expenditures. Contributions may be made beginning January 1, 2026 but may not be made after December 31, 2029.
