In 2022, the Commercial Liens Act was approved. On May 12, 2025, the BC Government passed a regulation to bring the new Commercial Liens Act into law starting on June 30, 2025. Also on May 12, regulations under that Act were passed.
The text of the Commercial Liens Act and its regulations should be posted on the government BClaws website soon.
According to the BC Government, the Commercial Liens Act replaces the patchwork of laws, such as the Repairers Lien Act, Warehouse Lien Act, and common law rules, regarding liens for anyone who repairs, stores or transports goods. Also, according to the BC Government, the legislation allows a commercial lien to be registered in the Personal Property Security Registry and the new legislation makes it easier to enforce liens without going to court. The new legislation moves BC closer to having one set of lien rules across Canada. According to the BC Government News release, all current liens under the Repairers Lien Act and Warehouse Lien Act will continue as commercial liens on June 30, 2025.
