Choice Partners recently hosted its annual workshop with Disaster Recovery Services (DRS) at Landry's Seafood, located on the Kemah Boardwalk.
Dr. Kim Abrego, chief operating officer, opened the event to cover procurement for disaster recovery alongside Shelley Vineyard, director of procurement specialty.
A focus for the discussion highlighted amendments to The Build America, Buy America Act (BABA).

The event was open for any CP members within 100 miles to participate and discuss strategies to prepare for the upcoming hurricane season and other disasters with federal funds and procurement methods.

| A new certification of compliance with domestic preferences is required when federal funds are used for infrastructure projects, based on recent amendments to the Code of Federal Regulations. The Build America, Buy America Act (BABA) became effective on May 14, 2022, and the U.S. Office of Management and Budget’s final rule providing guidance on the Buy America preferences became effective on Oct. 23, 2023. | | | |
BABA requires that funds made available for a federal financial assistance program for infrastructure must not be obligated for a project unless all of the iron, steel, manufactured products and construction materials incorporated into the project are produced in the United States.
Infrastructure is defined to mean public infrastructure projects, including buildings and real property, utilities and broadband infrastructure, among others. When necessary, federal award recipients may apply for and the federal agency may grant waivers from the BABA requirements.
Noncompliance with the BABA requirements would constitute a violation of the terms and conditions of the federal award and could result in the reduction or termination of the federal award. In the new BABA certification, vendors are required to certify compliance with all applicable BABA provisions and requirements, including those specific to the federal agency awarding the financial assistance.
The BABA requirements must also flow down to subrecipients at all tiers, including all contracts and purchase orders for work performed or products supplied under the federal award. Specific details regarding the BABA preferences may be found in the new CFR part, 2 C.F.R. Part 184 (https://www.ecfr.gov/current/title-2/subtitle-A/chapter-I/part-184). Choice Partners has updated its vendor packet to include a certification of BABA compliance.
